Motorcycle riding, motorsports, cycling, sporting activities, outdoor activities, training activities, and other potentially hazardous activities involve inherent risks and may result in property damage, serious bodily injury, or death.
Certain ZAMGEAR products may incorporate features including:
- Knuckle guards
- Reinforced knuckle areas
- Finger guards
- Padded palms
- Reinforced stitching
- Full-finger or half-finger coverage
- Leather or synthetic construction
- Mesh construction
- Wrist closures
- Touchscreen-compatible fingertips
- Other reinforced design features
Descriptions such as "hard knuckle," "knuckle guard," "knuckle protection," "reinforced," "padded," "motorcycle glove," "tactical glove," or similar terminology describe product construction, features, style, category, or intended use and do not constitute a guarantee that the product will prevent injury in an accident or other incident.
No motorcycle glove, tactical-style glove, garment, or other item of equipment can provide complete protection against every possible injury resulting from a fall, collision, slide, impact, loss of control, or other accident or incident.
The performance of gloves and other equipment may vary depending upon circumstances including:
- Speed
- Force of impact
- Angle of impact
- Type of surface
- Sliding distance
- Duration of abrasion
- Objects contacted
- Fit and sizing
- Product condition
- Nature of the accident
- Manner in which the product is worn or used
Unless ZAMGEAR expressly provides a specific written representation supported by applicable testing or certification, ZAMGEAR does not guarantee any particular degree of protection against injury.
Use of ZAMGEAR products does not eliminate the inherent risks associated with motorcycle riding, cycling, sporting activities, outdoor activities, or other potentially hazardous activities.
Customers should use appropriate equipment, follow applicable laws and safety practices, and use products only for lawful purposes.
Nothing in this section limits any right or remedy that cannot lawfully be waived or limited.
SECTION 4 — PRODUCT CERTIFICATIONS AND PERFORMANCE CLAIMS
Unless expressly stated on the applicable product page, ZAMGEAR products should not be understood to possess any particular certification, regulatory approval, impact rating, abrasion rating, performance classification, or safety certification.
References to physical features such as knuckle guards, reinforced areas, padding, leather construction, synthetic construction, mesh construction, or similar characteristics describe the physical construction, features, or intended use of the product.
Where ZAMGEAR expressly identifies a particular certification, standard, rating, or tested performance characteristic, that representation applies only to the specific product for which it is stated.
Customers should not assume that one product's certification, testing, or performance characteristics apply to another product.
SECTION 5 — PRODUCT INSPECTION, FIT, AND CONDITION
Customers should inspect products before use.
Do not use a product if it exhibits significant damage, excessive wear, torn or failed stitching, damaged closures, cracked or damaged components, severely damaged leather or materials, or another condition that could materially affect its intended function.
Products involved in a significant collision, impact, accident, fall, or other damaging event may require replacement even when damage is not immediately visible.
Proper sizing and fit are important. Customers should review the applicable size chart before ordering and confirm that a product fits appropriately before use.
Customers are responsible for maintaining products appropriately and replacing products when necessary.
SECTION 6 — ORDERS
Submitting an order constitutes an offer to purchase the products identified in the order.
ZAMGEAR reserves the right to accept, reject, limit, or cancel orders as permitted by applicable law.
An order is not finally accepted until payment has been successfully processed and the order has been accepted for fulfillment.
Please review your order carefully before submitting it.
Once an order enters processing or fulfillment, we may not be able to cancel or modify it.
If we reject, cancel, or materially modify an order, we will attempt to contact you using the information provided with your order.
Unless otherwise expressly authorized by ZAMGEAR, products purchased through our retail website are intended for personal or household use and not unauthorized commercial resale.

Shipping and delivery dates provided by ZAMGEAR are estimates unless expressly stated otherwise.
Actual delivery times may be affected by carrier operations, weather, customs processing, transportation disruptions, holidays, governmental actions, natural disasters, and other circumstances outside our reasonable control.
Risk of loss and responsibility for shipped products will be determined according to applicable law.

Nothing in our Refund Policy or these Terms eliminates consumer rights that cannot lawfully be waived.

WITH RESPECT TO PRODUCTS SOLD BY ZAMGEAR, ANY DISCLAIMER OR LIMITATION OF WARRANTY APPLIES ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
ZAMGEAR DOES NOT WARRANT THAT USE OF ITS WEBSITE WILL ALWAYS BE UNINTERRUPTED, SECURE, AVAILABLE, OR ERROR-FREE.
DESCRIPTIONS OF PRODUCT FEATURES DO NOT CONSTITUTE A GUARANTEE THAT A PRODUCT WILL PREVENT BODILY INJURY, DEATH, PROPERTY DAMAGE, OR AN ACCIDENT UNLESS ZAMGEAR EXPRESSLY PROVIDES A WRITTEN WARRANTY OR REPRESENTATION STATING OTHERWISE.

SECTION 20 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZAMGEAR, ZAM786786 LLC, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE SERVICES OR TRANSACTIONS THROUGH THE SERVICES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOST BUSINESS OPPORTUNITIES, OR SIMILAR ECONOMIC LOSSES, EXCEPT WHERE SUCH LIABILITY CANNOT LAWFULLY BE LIMITED.
ZAMGEAR DOES NOT GUARANTEE THAT USE OF A GLOVE OR OTHER PRODUCT WILL PREVENT AN ACCIDENT, FALL, COLLISION, IMPACT, ABRASION, BODILY INJURY, OR DEATH.
MOTORCYCLE RIDING, MOTORSPORTS, CYCLING, SPORTING ACTIVITIES, OUTDOOR ACTIVITIES, TRAINING ACTIVITIES, AND OTHER POTENTIALLY HAZARDOUS ACTIVITIES MAY INVOLVE RISKS THAT CANNOT BE ELIMINATED THROUGH THE USE OF GLOVES OR OTHER EQUIPMENT.
NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
Nothing in these Terms eliminates any legally required remedy arising from a product defect, unlawful conduct, or another matter for which liability cannot legally be waived.
SECTION 21 — INHERENT RISKS
By participating in motorcycle riding, motorsports, cycling, sporting activities, outdoor activities, training activities, or other potentially hazardous activities, you acknowledge that those activities involve inherent risks independent of the products purchased from ZAMGEAR.
Purchasing or using ZAMGEAR gloves or equipment does not eliminate those risks.
Customers are responsible for determining whether they possess appropriate skills, training, licensing, equipment, experience, and physical ability to participate in their chosen activities.
Customers are encouraged to use appropriate additional equipment and comply with applicable laws and safety practices.
This section does not waive or limit any right or remedy that cannot lawfully be waived.
SECTION 22 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless ZAMGEAR, Zam786786 LLC, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, costs, and reasonable attorneys' fees arising from:

If a provision of these Terms is determined by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.
The remaining provisions will continue in effect.

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or another right.
These Terms, together with policies and terms expressly incorporated by reference, constitute the agreement between you and ZAMGEAR concerning use of the Services and supersede prior agreements concerning the same subject matter.
Nothing in this section eliminates legally required representations, warranties, or consumer protections.
SECTION 25 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent except where applicable law provides otherwise.
ZAMGEAR may assign or transfer its rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of assets, or similar legitimate business transaction, subject to applicable law.

To the extent permitted by applicable law, these Terms and disputes arising from or relating to these Terms or the Services will be governed by the laws of the State of New York, without regard to conflict-of-law principles.
Subject to rights that cannot lawfully be waived, legal proceedings concerning these Terms or the Services may be brought in an appropriate state or federal court located in Kings County, New York, and the parties consent to the jurisdiction of those courts.
Nothing in this section deprives a consumer of mandatory protections or legal rights that cannot lawfully be waived.
SECTION 27 — NO PROFESSIONAL OR SAFETY ADVICE
Information provided through the ZAMGEAR website, including product descriptions, size charts, photographs, videos, demonstrations, advertisements, social-media content, customer reviews, and informational materials, is provided for general informational and commercial purposes.
Nothing provided by ZAMGEAR constitutes medical, legal, engineering, professional motorcycle-training, accident-prevention, or professional safety advice.
Customers should obtain appropriate professional training or advice when necessary.
SECTION 28 — TERMINATION
We may suspend or terminate access to the Services where reasonably necessary because of material violations of these Terms, unlawful activity, fraud, abuse, security risks, or other legitimate business reasons.
Termination does not eliminate obligations arising before termination.
Provisions concerning intellectual property, warranties, limitations of liability, indemnification, governing law, and other provisions that by their nature should survive termination will remain effective.
